Legislation

Legislation

The principle legislation for mining safety and health is the Coal Mining Safety and Health Act 1999 and the Mining and Quarrying Safety and Health Act 1999. These Acts introduce a risk management regime to legislation and require risks to the safety and health of persons from mining to be at an acceptable level.

Section 3 of the Workplace Health and Safety Act 1995 specifically exempts mines and quarries which fall under the mining safety and health legislation from that Act.

Codes of Practice/Recognised Standards

A code of practice provides practical guidance on how to comply with a general duty or a specific duty. It describes, without being prescriptive, safe work practices that can be used to reduce the risk of work-related injury and disease.
Work practices included may not represent the only acceptable means of achieving the standard to which the code refers.

Compliance with codes of practice is not mandatory but they may be used by courts as the standard when assessing other methods or practices used.
